A desobediência civil de Thoreau diante do contratualismo de Hobbes

Abstract

This paper aims to analyze the concept of civil disobedience proposed by Henry David Thoreau towards the contractualism philosophy of Thomas Hobbes. This proposal has the finality of justifying civil disobedience as an act of moral character in Thoreau‟s philosophy, using it as a possible appropriate reformulation of the rights of resistance, as an ally to the subject in the civil state. Thus, it will first be a presentation and philosophical analysis of both authors, prioritizing the necessary concepts for the contextualization understanding and theorization about the political concept treated by each of them. Having this as foundation, it will be possible to develop the concept of civil disobedience from the understanding of the rights of resistance approached by Hobbes, as an act that would question the limited position which the subject finds itself after the social contract. This proposal does not intend to prove the act of political civil disobedience as something effective, but aims to “enable a dialog” which discuss the necessity of turning the subject actions more flexible, keeping in mind its non-participation in the power inside the absolutist and monarchist state of Thomas Hobbes.
