O senso de justiça: uma justificativa moral para a desobediência civil

Abstract

This text consists of an analysis of the Rawlsian theory of justice and how the sense of justice is able to morally justify civil disobedience in the context of more or less fair and democratic and plural societies. John Rawls lays the foundations of his theory based on the Principles of Justice and on a procedural idea to achieve it. The procedure begins in the Original Position, together with the Veil of Ignorance and the Reflective Equilibrium permeated by a notion of social cooperation between individuals who seek their own good, the good of others and fair institutions. It is from the Original Position that the Principles of Justice are defined and that they are, in short, the guidelines for the actions and legislative constructions of this society. Thus, the defined Principles are capable of creating a Sense of Justice in the individual in the citizens in the face of everyday situations. The appeal to Civil Disobedience is also an appeal to the S.J of the individual, once the legal means and the required procedure are exhausted, the appeal to the individual's morality remains, that is, to the Sense of Justice morally justifying the Civil Disobedience is to establish a valid justification for the action in a political sphere that contemplates individuals and is reasonable and virtuous. The bibliographic analysis was used as a methodology for the textual construction.
