As organizações da sociedade civil e o sistema prisional: considerações sobre o marco regulatório das organizações da sociedade civil e o estudo de caso do programa de gestão prisional no presídio estadual de Lagoa Vermelha/RS no período de 2019 a 2022

Abstract

In the challenge of seeking solutions to Brazilian social problems, we observe the emergence of entities born of free organization and social participation of the population and which are responsible for non-profit public interest actions, acting in the most diverse sectors of society, being responsible for strengthening capacities to formulate and implement policies of collective interest, they are also known as Civil Society Organizations – CSOs. This dissertation aims to broaden the understanding of the potential for action by CSOs related to working with the prison system and to point out evidence to support the performance of the public power in the execution of policies that involve this theme. For this, the case study experience was analyzed - Prison Management Program (PGP), carried out in the State Prison of Lagoa Vermelha, located in the State of Rio Grande do Sul - Brazil, from its formulation, in 2019, to its ending in 2022. It is qualitative research, with a dialectical approach, using the analytical methodological bias based on implementation studies and methodology of the analysis of social networks - ARS (WASSERMAN; FAUST, 1994). Data were analyzed using the GEPHI software. It started with the study, the understanding of the State and its policies, then moving on to the understanding of penitentiary policies, the prison system, the state and federal budget transfers made possible by the Pluriannual Plan (2019-2022) and by the National Penitentiary Fund (FUNPEM) until getting to know the current penal policies applied in the subnational context. This path brings us closer to the understanding of CSOs, especially those that work in the field of human rights, to reach the Community Councils, essential for the implementation of the Prison Management Program. Understanding the legal device, Law 13.019/14, known as MROSC - Regulatory Framework for Civil Society Organizations, was a necessary prerogative to arrive at the case study, the PGP. In the study of the PGP, attention was paid to understanding the locus of the experience, the actors involved, the instruments used, and the paths taken in the construction of the PGP. The results indicate the importance and potential of CSOs for the implementation of penitentiary policies and show the positive and negative impacts that have occurred. This dissertation supports the construction of policies related to the prison system through CSOs.
