Title: A justiça enquanto possibilidade: uma análise do contrato social hobbesiano

Resume: Neste trabalho apontamos que o pacto social para Hobbes é visto como o movimento que salva o indivíduo dele mesmo, de sua condição de miséria, necessidade, carência e desespero. Através da sua criação, passa a se assegurar a possibilidade de vida em plenitude, sem os constantes perigos, como a morte violenta, que espreita no Estado de Natureza. O Estado Civil é criado em meio ao caos pelos próprios homens, indivíduos que identificam sua necessidade para manutenção da vida. Todavia, em meio aos debates históricos acerca do tema, acaba-se esquecendo de questionar há possibilidade de justiça nesta ação. O objetivo aqui é analisar o processo que leva o homem à assinatura do acordo e se este pode ou não ser considerado justo. Para isto, busca-se expor como as paixões humanas são voláteis e seu forte poder sobre o homem, culminando na necessidade de um pacto para evitar a autodestruição. Na sequência difere-se o Estado de Natureza do Estado Civil. Por último objetiva-se explanar o funcionamento do Estado Soberano e dissertar acerca de sua possibilidade de ser ou não justo. O Soberano deve assegurar a vida e evitar que se rescinda à guerra. Para isto, a obediência dos súditos é fundamental e a voz do Estado deve ser sempre seguida.
Abstract: This research aims to show that the Social Pact is seen as a movement that saves the individual from him/herself, from its misery, necessity, scarcity and despair. From its creation, the possibility of a life to the full is ensured, without constant dangers, such as violent death, lurking in the State of Nature. Man in between chaos creates the Civil Status to identify their needs to maintain life. However, amidst historical debates on the subject, the possibility of questioning on the existence of justice is forgotten. The objective here is to analyze the process that leads the man to sign the agreement and if it can be considered as fair. For that, this research aims to expose how human passions are volatile and its great power over man, which culminates on the need pf a pact to avoid self-destruction. After that, the State of Nature is distinguished from the Civil State. Lastly, this work tries to explain the functioning of the Sovereign State and if it is fair or not. The Sovereign must assure life and avoid war. For that, the obedience of the subjects is fundamental and the voice of the State must always be followed.
