Ressocialização por meio da educação: um estudo de caso em Florianópolis-SC

Abstract

Prison punishment is one of the oldest forms of punishment in the world, where, currently and in line with the Brazilian legal system, it should only restrict the freedom of the person who attempted/committed any crime. The arrest should also, besides restricting the freedom of this person, provide instruments to be resocialized later, not returning to the commission of crimes, conferring treatment that preserves the dignity of the human person of the arrested. However, in Brazil this does not normally occur. Brazil has the third largest prison population in the world, an index of recidivism in the commission of crimes of around 80% and does not present discussions and / or public policies to encourage resocialization. In Brazil there are some of the worst prisons in the world and there is a significant increase in the prison population. It is understood that one of the possibilities for altering this negative scenario of the Brazilian prison system would be to provide the prisoners with access to education. The goal of this work was to reflect on the legality and importance of education, more closely at the higher level, in the process of resocialization of the victims, besides presenting the current reality in Brazil on the subject. Documentary, bibliographical and field research was used by methodology; interviews were carried out with those responsible for the institution of this project, reporting how this occurred, how it has occurred and the gaps in the iniciative. In this sense, in Florianópolis-SC, there is a pioneering initiative in the state reality of providing the people with access and attendance at the public higher education institution. As a result of the research, it was found that through this partnership there was access to higher education, even with some already graduating. In addition, through bibliographic / legal research, it is verified that there is legal provision for the resocialization of those who are saddened by education and that at least in theory this is the intention of the legislator, the penalty and the prison itself. The results point out that the pioneering initiative, at the state of Santa Catarina, to provide access and face-to-face attendance at the higher education institution, specifically at UFSC, is a unique opportunity in the reality of those involved, caring an expansion of this initiative, as well as extending it to other localities, as it presents relevant moral and social value to the growing prison population, which suffers from various problems and few alternatives.
