Resume: | Essa dissertação trata do problema da justiça em Thomas Hobbes. O filósofo, em seus textos, apresenta uma tensão, a qual provoca discussões interpretativas entre duas posições que se contrapõe, pois ele trata da justiça como uma lei de natureza, no entanto, afirma que não existe lei sem um poder comum. Esse poder comum, ou obrigação diante das leis, origina-se no contrato, o qual leva ao estabelecimento do Estado. Para embasar a necessidade do Estado, Hobbes apresenta um estado de natureza caótico, em que não há medida comum de certo e errado, e os conflitos de opiniões geram um estado de guerra de todos contra todos. A definição de justiça, para o filósofo, é o cumprimento de contratos, os quais só são válidos a partir da instituição do Estado, pois é somente ele que tem poder e autoridade para garantir o cumprimento. De tal forma, que a justiça só pode ser efetivada a partir do surgimento do soberano, ou seja, a justiça passa a ser artificial. |
Abstract: | This dissertation deals with the problem of justice in Thomas Hobbes. In his texts, the philosopher presents a tension that provokes interpretive discussions between two opposing positions. He talks about justice as a law of nature, however, he asserts that there is no law without a common power. This common power, or obligation to obey the laws, originates in the contract, which leads to the establishment of the State. To support the necessity of the State, Hobbes presents a chaotic state of nature, in which there is no common measure of right and wrong, and conflicts of opinion generate a state of war of all against all. The definition of justice, for the philosopher, is the fulfillment of contracts, which are only valid from the institution of the State, since it is only the State that has the power and authority to guarantee compliance. Therefore, justice can only be effective from the emergence of the sovereign, meaning that justice becomes artificial. |
